These Terms of Service (“Terms”) govern your use of the website, services, and communications provided by West Philly Tool Library Inc. (“WPTL,” “we,” “us,” or “our”), a 501(c)(3) nonprofit organization located at 1223 S Harmony St, Philadelphia, PA 19146. By accessing our website, becoming a member, borrowing tools, registering for classes, or otherwise using our services, you agree to these Terms.
Membership is open to individuals age 18 and older. Members must complete a membership application, verify their identity with valid government-issued photo ID, and agree to our Lending Policy and waiver. Memberships are annual, may auto-renew, and are subject to the terms described in the Lending Policy. WPTL reserves the right to refuse, suspend, or revoke membership at its discretion.
All tool borrowing is governed by our Lending Policy, which is incorporated into these Terms by reference. Members agree to return tools on time, in the condition received (minus normal wear and tear), and to pay any applicable late fees, damage costs, or replacement charges as described in the Lending Policy.
Class registration is subject to availability. WPTL may cancel, reschedule, or modify classes at any time. Cancellation and refund terms are described in our Class Cancellation Policy. Participants assume all risks associated with class attendance and tool use during classes.
Rental of equipment is subject to rental-specific terms presented at the time of reservation, including security deposits, rental duration, damage responsibility, and delivery/pickup requirements. Renters must provide a valid driver’s license and payment method. WPTL reserves the right to refuse rentals at its discretion.

You may opt out at any time by replying STOP to any text message. Reply HELP for assistance. Opting out of SMS does not affect your membership or access to services.
Consent to receive SMS messages is not a condition of membership, purchase, or participation in any program. We will not sell, rent, or share your phone number or opt-in consent with third parties for marketing purposes.

Payments for memberships, classes, rentals, and donations are processed through Stripe, a PCI-compliant payment processor. By providing payment information, you authorize us to charge the applicable fees. All fees are described at the time of transaction. Refund eligibility is governed by the specific policy applicable to the transaction (membership, class, or rental).

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use. WPTL is not liable for losses resulting from unauthorized account access.
All content on our website, including text, images, logos, and design, is the property of West Philly Tool Library Inc. or used with permission. You may not reproduce, distribute, or create derivative works from our content without written permission, except for personal, non-commercial use.
To the fullest extent permitted by law, WPTL, its officers, directors, volunteers, and employees shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services, tools, website, or participation in classes or events. Our total liability for any claim shall not exceed the amount you paid to WPTL in the twelve months preceding the claim.
You agree to indemnify and hold harmless WPTL, its officers, directors, volunteers, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
Our services and website are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved in the courts of Philadelphia County, Pennsylvania.
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
